About these terms
These Terms of Use ("Terms") are an agreement between you and MuffinLine ("we", "us" or "our") about your use of Vacaylo - CountryTracker ("Vacaylo", the "app"). By using Vacaylo, you accept these Terms.
Our Privacy Policy explains how we handle your information, and our Community Rules (in About & Help) are part of these Terms.
Who can use Vacaylo
You must be at least 13 years old, or the minimum age required in your country. If you are a minor where you live, you need a parent's or guardian's permission, and they accept these Terms for you.
Your account
Vacaylo creates an anonymous account for you automatically. You can optionally link Sign in with Apple (iPhone/iPad) or your Google account (Android) to keep your account, username and friends when you change phones. Without it, a lost or reset device may mean a lost account. You are responsible for activity on your account.
Your license to use the app
We give you a personal, non-transferable, revocable license to use Vacaylo on Apple or Android devices you own or control, for non-commercial purposes, under these Terms and subject to the App Store's Usage Rules or the Google Play Terms of Service, as applicable. The app, including its design, maps and code, belongs to us and our licensors.
Your travel log
You can mark countries as Visited, Lived, Transit or Want to go, log visits, cities, airlines, notes and photos, and see your maps, stats and achievements. Your log is saved on your device first and synced to your account when you are online.
Sync can fail, so we recommend exporting your data regularly (Profile → Data & sync). Maps and borders are for personal record-keeping only.
Explore, friends and sharing
Explore and friends require a username. You can also add a display name, a badge and, where available, a profile picture. Public profiles, including visit photos, are visible to other users in Explore; private profiles only to your accepted friends.
Vacation Mode, a Premium feature, is shared only with your accepted friends, and only when you turn sharing on.
When you share images to Instagram, Snapchat or other apps through the share sheet, that service's terms apply, and we cannot remove what you shared.
Your content
You keep ownership of what you add to Vacaylo, such as your profile details, notes and photos ("your content"). You are responsible for it and confirm you have the right to share it.
You give us a worldwide, non-exclusive, royalty-free license to store, copy, resize and display your content only to run Vacaylo, including showing it to the audience your settings allow. This license ends when you delete the content, apart from copies kept while deletion completes, to review a report, or to comply with the law.
Community Rules and prohibited conduct
Everything you share must follow our Community Rules. You must also not:
- Break the law or infringe anyone else's rights, including copyright and privacy.
- Harass, threaten, impersonate or mislead others.
- Post sexual, violent, hateful or dangerous content, or anyone else's personal information or location.
- Use Vacaylo for advertising, spam or bulk friend requests.
- Access other people's data without permission, overload the service, or bypass its security, limits or Premium features.
- Copy, scrape, reverse engineer or resell the app, or use automated tools to create accounts or collect information, except where the law allows it.
Reporting, blocking and enforcement
You can report or block a user from the ⋯ menu on their profile or photo. Blocking hides you from each other in Explore and removes any friendship or request between you.
We review reports and may remove content, hide profiles, or suspend or end access for anyone who breaks these Terms or the Community Rules. We are not responsible for content posted by other users.
Premium and purchases
Vacaylo is free to use and has no ads. Premium unlocks extra features, such as the 3D globe, city and airline tracking, custom map colors and Vacation Mode. You can buy Premium as a one-time lifetime purchase, which lasts as long as we offer Vacaylo and its Premium features, or as a 6-month auto-renewing subscription. Use the restore option in the app to restore a purchase.
A subscription renews automatically every 6 months at the price shown in the app, unless you cancel it at least 24 hours before the end of the current period. The renewal is charged to your App Store or Google Play account. You can manage or cancel your subscription at any time in your App Store or Google Play account settings, or in the app at Profile → Manage subscription. Cancelling stops future renewals, and you keep Premium until the end of the period you have paid for. Deleting the app or your Vacaylo account does not cancel a subscription.
Purchases are processed by the store you buy through, Apple (App Store) or Google (Google Play), and that store's terms apply to them. We use RevenueCat, a service provider, to manage purchases and subscriptions. We never receive your payment details. Refunds are handled only by Apple or Google under their policies; we cannot issue them.
We may offer limited-time discounts on lifetime Premium, for example on certain holidays. The offer price and end time are shown in the app, and offers do not apply to earlier purchases.
Ending your use
You can delete your account and data in the app at About & Help → Delete account. Deletion removes your account, travel data, photos, friends and Premium status. Photos named in an open report are kept until the report has been reviewed, then deleted. Deletion records and any leftover files are permanently erased within 1 year. You can also contact pizzadyche@gmail.com to request deletion. Deletion does not refund Premium and does not cancel an active subscription: cancel it first in your App Store or Google Play subscription settings.
We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering Vacaylo. The disclaimer and liability sections survive.
Disclaimers
Vacaylo is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, including that the app will be uninterrupted, error-free or secure, or that stats, achievements, country detection or suggestions will be accurate. Vacaylo is not a travel, visa or safety service.
Limitation of liability
To the fullest extent the law allows, MuffinLine is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from Vacaylo. Our total liability for any claim is limited to the amount you paid MuffinLine for Premium in the 12 months before the claim, so it is zero if you paid nothing. This does not limit liability that cannot legally be limited, or your consumer rights.
App stores
Vacaylo is available from the Apple App Store and Google Play. These Terms are between you and MuffinLine, not Apple or Google.
Apple App Store: Apple is not responsible for Vacaylo, its maintenance, support or claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play: for downloads from Google Play, the Google Play Terms of Service also apply, and Google is not responsible for Vacaylo, its maintenance, support or claims about it.
Changes to these terms
We may update Vacaylo and these Terms. We will change the date at the top and tell you in the app before significant changes take effect. Continuing to use Vacaylo means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Canada, and disputes will be handled by its courts, unless your local law lets you bring a claim where you live. If any part of these Terms is unenforceable, the rest stays in effect.
